  • Creator Insights: Access detailed information about content creators, their performance, and audience engagement
  • Trend Analysis: Stay updated with the latest viral trends, formats, and emerging content categories
  • API Access: Integrate ViralFleet data into your own applications and workflows (premium plans)

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Immediately notify us of any unauthorized use of your account

3.3 Account Termination

7. Subscription Plans and Payments

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALFLEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to us in the last twelve (12) months, or $100, whichever is greater.

We shall not be liable for any loss of profits, revenue, data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless ViralFleet, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit, post, or transmit through the Service
  • Your violation of any applicable laws or regulations

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Before pursuing formal dispute resolution, we encourage users to contact us directly to resolve any issues. Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules.

You waive any right to participate in class-action lawsuits or class-wide arbitration.

11.3 Jurisdiction

You agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

If you disagree with the revised Terms, you may discontinue using the Service. Your continued use after the effective date constitutes acceptance of the new Terms.

13. Termination

You may terminate your account at any time by following the account deletion process in your settings or by contacting our support team. Termination will take effect immediately or at the end of your current billing period.

We may terminate or suspend your account and access to the Service, without prior notice or liability, for any reason, including:

  • Non-payment of fees
  • Abusive or harmful behavior
  • Legal or regulatory requirements
  • Business or operational reasons

13.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account data, though some information may be retained as required by law or for legitimate business purposes.

14. Miscellaneous Provisions

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViralFleet regarding the Service.

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights to any affiliate or successor.
